I consent<\/strong> to the creation, use, \u00a0reproduction, distribution, exhibition, and public presentation (hereinafter \u00a0referred to as „use“) of photo, video, and audio recordings made of \u00a0me during the above-mentioned event (hereinafter collectively referred to as \u00a0„data“). The consent includes the use of the data by osapiens \u00a0Services GmbH and its affiliated companies (referred to as „Controllers<\/strong>“ \u00a0in terms of data protection law) and applies to the following purposes:<\/p>\n

\u00b7\u00a0\u00a0\u00a0\u00a0 \u00a0Use \u00a0in internal and external media and communication platforms<\/strong>;<\/p>\n

\u00b7\u00a0\u00a0\u00a0\u00a0 \u00a0Use \u00a0on the Controllers\u2019 own websites, including the career website<\/strong> and \u00a0publication on social media channels<\/strong> (e.g., LinkedIn, Xing, YouTube, \u00a0Facebook, Instagram, Kununu\/Glassdoor, Career Page, Twitter), and the \u00a0associated transmission to countries outside the EU;<\/p>\n

\u00b7\u00a0\u00a0\u00a0\u00a0 \u00a0Use \u00a0for public relations and advertising purposes<\/strong> of the Controllers \u00a0(e.g., annual reports, digital and printed brochures, advertisements, etc.).<\/p>\n

I hereby grant the Controllers a right of \u00a0use free of charge and unrestricted in terms of space and time.<\/p>\n

Insofar as my photo or video reveals \u00a0information about my ethnic origin, religion or health (e.g. skin color, \u00a0headgear, glasses), my consent also refers to this information.<\/p>\n

However, this consent can be retracted at any \u00a0time <\/strong>with effect for the future for new acts of use. Use of the data \u00a0for purposes other than those described is not permitted.<\/p>\n

During events, osapiens creates photo, video, and audio recordings in \u00a0order to document the event and publish impressions for marketing purposes. \u00a0Visitors of the event may be seen or heard in these recordings. For this \u00a0reason, osapiens requests consent for the creation and use of such \u00a0recordings.<\/p>\n

Further information on the intended use is derived from the \u00a0declaration of consent.<\/p>\n

2.\u00a0\u00a0\u00a0\u00a0 Legal basis of the processing<\/strong><\/p>\n

The data is processed based on the express consent pursuant to Art. 6 \u00a0(1) sentence 1 letter a) and Art. 7 of the EU General Data Protection \u00a0Regulation (GDPR<\/strong>), taking into account Section 22 of the German Art \u00a0Copyright Act (KunstUrhG<\/strong>).<\/p>\n

1.\u00a0\u00a0\u00a0\u00a0 \u00a0Revocation<\/strong><\/p>\n

The consenting party may revoke the granted consent at any time \u00a0with effect for the future<\/strong>. The revocation does not affect the lawfulness \u00a0of the processing carried out before the revocation. Therefore, publications \u00a0that have already been made (e.g. on websites or in social media channels are \u00a0not<\/strong> automatically deleted) and printed materials that have \u00a0already been produced may continue to be distributed. If, due to special \u00a0circumstances, further dissemination of printed materials is to be omitted or \u00a0deletion of publications is necessary, the consenting party must inform the \u00a0person responsible of the reasons together with the objection in text form.<\/p>\n

3.\u00a0\u00a0\u00a0\u00a0 \u00a0Recipient<\/strong><\/p>\n

Recipient of the data can be anyone within the scope of the consent, \u00a0in particular journalists, press agencies, visitors to the websites, users of \u00a0social media, etc. Furthermore, service providers within the scope of \u00a0commissioned processing, in particular commissioned web hosting Companies as \u00a0well as IT and media service providers. Data published online worldwide is \u00a0also accessible in countries with a low level of data protection. Further \u00a0dissemination and use by unauthorized third parties can therefore not be \u00a0ruled out. If consent is withdrawn, complete deletion of the recordings and \u00a0data from the Internet cannot therefore be guaranteed.<\/p>\n

Suitable search engines can be used to find data on the Internet and, \u00a0under certain circumstances, to identify the persons shown on the data. This \u00a0also makes it possible to create personality profiles by combining this data \u00a0and information with other data available on the Internet and to open up \u00a0additional possibilities for use, e.g. for advertising purposes. Due to the \u00a0possibilities of worldwide retrieval and storage of the data by other bodies \u00a0or persons, in the event of revocation of consent and despite removal of the \u00a0data from the website of the person responsible, further use by other bodies \u00a0or persons or retrieval via archive functions of search engines cannot be \u00a0ruled out.<\/p>\n

If consent is also given for affiliated Companies, the recipients of \u00a0the data are the respective affiliated osapiens Companies.<\/p>\n

2.\u00a0\u00a0\u00a0\u00a0 \u00a0Third country transfer<\/strong><\/p>\n

If consent is also given for affiliated Companies and Companies \u00a0outside the EU, the EEA or a country without an adequate level of data \u00a0protection receive data, the Controller ensures that EU standard contractual \u00a0clauses have been concluded with the recipient.<\/p>\n

When consenting to the publication of recordings on social media \u00a0platforms, data is regularly transferred to so-called third countries<\/strong> \u00a0outside the EU or the EEA, which are to be regarded as unsafe third countries \u00a0under data protection law. There is a possibility that the rights of data \u00a0subjects in third countries cannot be safeguarded or cannot be safeguarded in \u00a0full. For example, further processing by authorities and third parties cannot \u00a0be prevented in practice. It is also possible that recipients of data in \u00a0third countries will not or not fully comply with the obligations to provide \u00a0information. The Controller has no influence on how the operators of social \u00a0media platforms handle the data. Whether and for what purposes the data is \u00a0further processed by the operators is beyond the knowledge of the Controller.<\/p>\n

4.\u00a0\u00a0\u00a0\u00a0 \u00a0Storage Period<\/strong><\/p>\n

In the event of a revocation, the photo, film and sound recordings \u00a0will be deleted, provided that the cases mentioned under points 3 and 4 do \u00a0not apply. The data controller is not obligated to delete the data if the \u00a0photo and film recordings are group illustrations in which the data subject \u00a0concerned is not the focus. In all other cases, we store the data only for as \u00a0long as is necessary to fulfill the purposes pursued or due to legal or \u00a0contractual regulations and retention periods.<\/p>\n

3.\u00a0\u00a0\u00a0\u00a0 Controller under data protection law, Data Protection Officer<\/strong><\/p>\n
