The EUDR requires that any company dealing in one or more of the seven products listed, importing to or exporting from the EU - and there is a possibility that more products may be added to the list after a review by the EU - must prove that their products are deforestation-free and produced in compliance with the laws of the producing country. Various aspects such as land use, labor and human rights will be considered. In addition, companies are required to submit a Due Diligence Statement for their products. This obligation applies regardless of whether the company is from the EU and covers both legal and illegal deforestation within and outside the EU.

The competent authorities of each Member State check the due diligence statement and related documents before customs clearance. The likelihood of an inspection depends on the risk that the goods do not comply with the regulations. In Germany, the Federal Agency for Agriculture and Food (Bundesanstalt für Landwirtschaft und Ernährung, BLE) has already been designated as the "competent authority" for the implementation of the Regulation.

Under the EUDR, your obligations depend on your role: Operator: The company first placing an in-scope product on the EU market.

Operators must complete the full due diligence process and submit a DDS.

Importer: A company importing an in-scope product into the EU. Importers have the same obligations as operators.

Downstream operator: A company buying an in-scope product within the EU. They must verify that a DDS exists and keep records, but they do not redo the full due diligence.

Trader: A company selling in-scope goods on the EU market without transforming them. Traders have lighter requirements but must maintain documentation.

Many North American companies are technically suppliers, not EU operators. However, if your EU customer cannot complete their own due diligence without verified data from you, you function as a quasi-operator. This means: • You need to complete due diligence on your products. • Your EU customer depends on your verified risk assessment and geolocation data. • Without your documentation, they cannot submit a DDS.
