For SMEs (max. 250 employees, €25 million balance sheet total, €50 million turnover), the EUDR differentiates between market participants and traders:

• Market participants bringing products to the EU market for the first time, either by import or own production (e.g., cutting down a tree or importing coffee), are fully obligated to conduct due diligence. This includes a legality risk analysis, a deforestation risk analysis, creating a due diligence statement, and submitting it to the EU TRACE system.

• Traders or market participants who purchase, process, and distribute EUDR-relevant products within the EU are primarily required to collect information, document, store it, and cooperate with authorities.
